Countering Terrorism in the Post-9/11 World: Legal Challenges & Dilemmas

For the fourth consecutive year, the T.M.C. Asser Instituut and ICCT organised a Summer Programme on countering terrorism in a post-9/11 world from 25 - 29 August 2014 in The Hague. The focus of this year's programme was on legal challenges and dilemmas related to (counter-)terrorism.

More than a decade after 9/11, the international community is still fighting al Qaeda – the use of drones has become a common tool in terrorism hot spots, while leaks by Edward Snowden have revealed extensive spying activities in the US, Europe and beyond. This Summer Programme will focus primarily on issues related to rule of law: questions such as the scope and limitations of armed conflict, the interplay between international humanitarian law and international human rights law, as well as the use of drones, the role of intelligence and mass data collection, the police and prosecutors in counter-terrorism, on both the domestic level and the level of the international tribunals. The Programme will provide the legal background underlying pertinent questions that counter-terrorism (CT) professionals regularly face.

The objective of this unique Summer Programme was to provide participants with an overview of the topics outlined above, exploring the theoretical and more practical questions of the legality of many CT strategies. The programme aimed to provoke critical thinking about such issues as:

  • Defining Terrorism under International and Domestic Laws
  • The War Paradigm vs the Law Enforcement Paradigm;
  • The Role of International Humanitarian Law and International Human Rights Law in CT;
  • Targeted Killings and the Use of Drones: Legal, Moral, Technical and Efficiency Issues;
  • The Role of Intelligence and the Police;
  • The Protection and Use of Witnesses in Terrorism Cases;
  • Trying Terrorists at the Domestic and International Level;

Target Audience

The programme is tailored towards CT professionals with an academic background in areas such as law, security studies, international relations, conflict studies or other related fields who want to expand their knowledge of the underlying legal tenets and dilemmas in CT. It should be noted that a legal background for this course is desirable but not required. The programme is also open for advanced graduate students who wish to pursue a career in CT.

€ 1,695 This fee includes lectures, study materials, study visits, refreshments and lunch during workings days, a reception and an opening dinner.
